Agreement to Terms

These Terms of Service ("Terms") govern your use of the Countryside Websites website and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Description of Services

Countryside Websites provides web design and development services for small businesses, including:

• Custom website design and development
• Website hosting and maintenance
• Domain management assistance
• Website updates and modifications
• SMS appointment reminders and project communications (optional, with consent)

Our Build First, Pay Later Guarantee

We offer a unique guarantee: we build your website first, and you only pay if you're satisfied with the result. Here's how it works:

• No deposits or upfront payments required
• We build your complete website based on our initial consultation
• You receive a preview link to review your finished website
• You may request up to 2 rounds of revisions
• If you approve the website, you pay and we launch it
• If you're not satisfied after revisions, you may walk away with no obligation

This guarantee applies to new website builds only and is subject to our reasonable discretion regarding scope changes.

Pricing and Payment

Service Packages

Our current pricing is as follows (subject to change):

• Basic Package: $750 - Online presence website
• Standard Package: $1,000 - Lead generation website
• Shop Package: $1,500 - Simple e-commerce website
• Website Care: $150/year - Hosting, maintenance, and updates

Payment Terms

Payment is due upon approval of your completed website, before we publish it live. We accept major credit cards and other payment methods as specified during checkout.

Website Care Service

Our Website Care service ($150/year) includes:

• Website hosting on fast, reliable servers
• Domain renewal management
• Simple text and content updates (via text message or email)
• Up to 2 larger updates per year
• Security maintenance and monitoring

Website Care is billed annually. You may cancel at any time, but no refunds are provided for partial years.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your business
• Supply necessary content, images, and logos for your website (or allow us to create placeholder content)
• Respond to our communications in a timely manner
• Review and provide feedback on your website within a reasonable timeframe
• Ensure you have rights to all content you provide to us
• Pay for approved services in accordance with these Terms

Intellectual Property

Your Content

You retain ownership of all content, images, logos, and materials you provide to us. By providing content, you grant us a license to use it for the purpose of building and maintaining your website.

Our Work

Upon full payment, you receive full ownership of your custom website design and code. Until payment is received, all work remains the property of Countryside Websites.

Third-Party Assets

Some websites may include third-party fonts, icons, or images. We will ensure any such assets are properly licensed for your use.

SMS Communications

Consent

If you opt in to receive SMS messages from us, you consent to receive text messages for appointment reminders, project updates, and service communications. SMS consent is optional and not required to purchase our services.

Message and Data Rates

Message and data rates may apply. Check with your mobile carrier for details about your plan.

Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message or contacting us directly. See our Privacy Policy for complete details.

Age Requirement

You must be at least 18 years of age to opt in to our SMS messaging program.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

Limitation of Liability

To the maximum extent permitted by law:

• Countryside Websites shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of data, revenue, profits, or business opportunities
• We are not responsible for third-party services, including hosting providers, payment processors, or domain registrars

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• Your website will achieve specific business results
• Your website will rank in a particular position in search engines
• Our Services will be uninterrupted or error-free

Indemnification

You agree to indemnify and hold harmless Countryside Websites, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you provide to us

Termination

We may terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination:

• Your right to use our Services will immediately cease
• If you have an active Website Care subscription, no refund will be provided for the remaining term
• We may, at our discretion, provide you with your website files

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Colorado.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Countryside Websites regarding our Services.
